16982 - Appeal of J. Brendan Herron, Jr. and ANC 3F, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Department of Consumer and Regulatory Affairs (DCRA), in the issuance of building permit Nos. B446310, B446316 and B446312, issued on June 13, 2002, to Zuckerman Bros. allowing the construction of two single family dwellings in an R-1-A District. Appellant alleges that DCRA erred by not taking into consideration the provisions of the Forest Hills Tree and Slope Overlay, the plans violate the side yard requirements, and the ANC was not given statutory notice of the filing of the permit applications. The subject premises is located at 2900 and 2902 Albemarle Street, NW (Square 2043, Lots 9, 18 and 19). 16985 - Application of Bennett Beauty Institute, pursuant to 11 DCMR § 3103.2, for a variance from the use provisions to establish a trade school having 250 students and 24 teachers/staff under subsection 330.5, and a variance to allow 50 children in a child development center under subsection 330.5 (d), and a variance from the off-street parking requirements under section 2101, in the R-4 District at premises 700 Monroe Street, NE (Square 3657, Lot 827). 16987 - Application of Pablo Martinez, pursuant to 11 DCMR § 3104.1, for a special exception to allow a rear deck addition to an existing flat (two-family dwelling) under section 223, not meeting the lot occupancy (section 403), rear yard (section 404), and court area (section 406) requirements in the R-4 District at premises 1207 Clifton Street, NW (Square 2865, Lot 41). 16986 - Application of Loder & Gravett, LLC, pursuant to 11 DCMR § 3103.2, for a variance from the floor area ratio requirements under section 402, a variance from the lot occupancy requirements under section 403, a variance from the rear yard requirements under section 404, and a variance from the closed court requirements under section 406, to construct a 4 unit apartment house in the R-5-B District at premises 2131 - 2133 10th Street, NW (Square 358, Lots 58 and 59). 16983 - Application of Richard Nappi, pursuant to 11 DCMR § 3103.2, for a variance from the minimum lot area requirements under subsection 401.3, and a variance from the off-street parking requirements under section 2101, to allow the conversion of two contiguous row dwellings into a single 7 unit apartment building in the R-4 District at premises 505 and 507 O Street, NW (Square 479, Lots 36 & 37). 16991 - Application of Government of the District of Columbia, Office of the Chief Technology Officer, pursuant to 11 DCMR § 3104.1, for a special exception to replace and operate a support structure (150-foot monopole) and telecommunications facility as part of the District's emergency communications network under section 212 (section 2520) (Antenna, Other Than Commercial Broadcast Antenna), in the C-2-A District at premises 1700 Rhode Island Avenue, NE (Square 4134, Lot 800). 16988 - Application of Government of the District of Columbia, Office of the Chief Technology Officer, pursuant to 11 DCMR § 3104.1, for a special exception to replace an existing telecommunications tower and poles with one lattice tower and equipment shelter as part of the District's emergency communications network under section 212 (section 2520) (Antenna, Other Than Commercial Broadcast Antenna), in the R-5-B District at premises 320 McMillan Drive, NW (Parcel 108/6). 16982 - Appeal of J. Byrd, pursuant to 11 DCMR § 3103.2, for a variance from the use provisions to allow office use within a two story row dwelling under section 330.5, in the R-4 District at premises 714 10th Street, NE (Square 912, Lot 72). 16994 - Application of Richard Van Berkel, pursuant to 11 DCMR § 3104.1, for a special exception to construct a one-story rear addition to a one-family dwelling under section 223, in the R-5-B District at premises 1530 Swann Street, NW (Square 191, Lot 76). 16984 - Appeal of Advisory Neighborhood Commission (ANC), pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator in the issuance of Building Permit No. B47779, relating to the renovation of the River Inn Hotel. Appellant alleges that the Zoning Administrator erred by issuing a building permit where the proposed development would be in violation of the subsection 350.4 (d) (limitations on hotel use in the R-5 Districts) and subsection 351.2 (commercial adjuncts to hotels) of the Zoning Regulations, and where proper notice of the permit application was not given to the ANC. The subject premises is located in the R-5-E District at premises 924 25th Street, NW (Square 16, Lot 884). 16999 - Application of US Property Development Corporation, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 772, a variance from the residential recreation space requirements under section 773, a variance from the court requirements under section 776, to allow the construction of a six-story apartment building with ground floor retail space in the Arts/C-3-A District at premises 1401 and 1413 P Street, NW, 1502 and 1506 14th Street, NW, 1510 - 1520 14th Street, NW, and 1410 Church Street, NW (Square 209, Lots 1, (800 and 802), part of 2 (803), 36 (800), 34, 35 & 57-59 (916), 37 (837) and a portion of a public alley closed by Act 14-608). 16997 - Application of Kimiko W. Dornburg, pursuant to 11 DCMR § 3104.1, for a special exception to allow a one-story rear addition to a row dwelling under section 223, not meeting the side yard requirements (section 405) and the nonconforming structure provisions (subsection 2001.3), in the R-1-B District at premises 3312 Cathedral Avenue, NW (Square 2118, Lot 38). 16996 - Application of Martin Block, pursuant to 11 DCMR § 3104.1, for a special exception to allow an addition to an existing one-family dwelling under section 223, in the R-1-B District at premises 3348 Military Road, NW (Square 1991, Lot 35). 16995 - Appeal of Council of Co-Owners of the Capitol Park Two Condominium, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of Robert Kelly, Zoning Administrator, Department of Consumer and Regulatory Affairs (DCRA) for the issuance of Building Permit No. B448124, for the construction of two, six (6) story additions to a nine-story apartment building. Appellant alleges that DCRA erred by issuing the building permit as the proposed building exceeds the maximum allowable building height and floor area ratio requirements under sections 400 and 402, respectively. The subject property is located in the R-5-C District at premises 800 4th Street, SW (Square 540, Lot 106). |
