17004 - Application of Penny Platt, pursuant to 11 DCMR § 3103.2, for a variance from the minimum lot area requirements under subsection 401.3, to allow the conversion of an existing flat into a three (3) unit apartment house in the R-4 District at premises 244 and 244-A 12th Street, SE (Square 1015, Lot 213).

16974 - Application of Tudor Place Foundation, Inc., Inc., pursuant to 11 DCMR § 3104.1, for a special exception to continue the operation of a museum by a non-profit organization (last approved by BZA Order No. 16477, dated January 14, 2000), under section 217, in the R-1-B District at premises 1644 31st Street, N.W. and 1670 31st Street, NW (Square 1281, Lots 827 and 830).

16980 - Application of Scott R. Gillis, pursuant to 11 DCMR § 3104.1, for a special exception to change a nonconforming use (grocery store) to another nonconforming use (artist studio) under subsection 2003.1, and a variance from the requirement that a new nonconforming use is a "neighborhood facility" under subsection 2003.5, in the R-4 District at premises 301 12th Street, SE (1st floor) (Square 991, Lot 25).

16967 - Application of Government of the District of Columbia, pursuant to 11 DCMR § 3103.2, for a special exception from the penthouse set-back provisions under section 411 (840.3), and a variance from the building height requirements under section 840, to allow the construction of a two story building used for trash truck storage and administrative office space in the C-M-1 District at premises West Virginia Avenue and 15th Streets, NE (Square 4092, Lot 5).

16974 - Application of Tudor Place Foundation, Inc., Inc., pursuant to 11 DCMR § 3104.1, for a special exception to continue the operation of a museum by a non-profit organization (last approved by BZA Order No. 16477, dated January 14, 2000), under section 217, in the R-1-B District at premises 1644 31st Street, N.W. and 1670 31st Street, NW (Square 1281, Lots 827 and 830).

16958 - Application of DC Government Department of Public Works, pursuant to 11 DCMR § 3104.1, for a special exception to allow improvements, including the addition of a recycling and drop-off center, to an existing solid waste transfer facility under subsection 822.3, at premises 3200 Benning Road, NE (Parcel 169/111). Note: The Zoning Commission is considering a request to amend the zoning of the subject property from unzoned to the M District.

17005 - Application of The Studio Theater, Inc, pursuant to 11 DCMR § 3103.2, for a variance from the rear yard requirements under section 774 and 2001.3, and pursuant to 11 DCMR § 3104.1, a special exception to allow more than one roof structure, one of which provides screening walls that would not be of equal height under section 771 (section 411), and a special exception to allow less than 50% of the surface area of the street wall along 14th Street at the ground level to be used for display windows and entrances under section 1903 and 1906, to allow additions to existing buildings (to be consolidated into a single building on a single record lot) for use as a legitimate theater in the Arts/C-3-A District at premises 1501, 1507 and 1509 14th Street, NW (Square 241, Lots 830, 834, and 835).

16967 - Application of Government of the District of Columbia, pursuant to 11 DCMR § 3103.2, for a special exception from the penthouse set-back provisions under section 411 (840.3), and a variance from the building height requirements under section 840, to allow the construction of a two story building used for trash truck storage and administrative office space in the C-M-1 District at premises West Virginia Avenue and 15th Streets, NE (Square 4092, Lot 5).

16998 - Appeal of Advisory Neighborhood Commission, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of David Clark, Director, Department of Consumer and Regulatory Affairs (DCRA) for the issuance of Building Permit No. B425438, for the renovation of a warehouse for use by a community corrections center. Appellant alleges that DCRA erred by issuing the building permit as the proposed use will allegedly be operated as a community based residential facility (halfway house) and therefore in violation of the prohibition of new residential use in a C-M District pursuant to section 801. The subject property is located in the C-M-2 District at premises 2210 Adams Place, NE (Square 4259, Parcel 154/81).

16984 - Appeal of Advisory Neighborhood Commission, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator in the issuance of Building Permit No. B47779, relating to the renovation of the River Inn Hotel. Appellant alleges that the Zoning Administrator erred by issuing a building permit where the proposed development would be in violation of the subsection 350.4 (d) (limitations on hotel use in the R-5 Districts) and subsection 351.2 (commercial adjuncts to hotels) of the Zoning Regulations, and where proper notice of the permit application was not given to the ANC. The subject premises is located in the R-5-E District at premises 924 25th Street, NW (Square 16, Lot 884).

16974 - Application of Tudor Place Foundation, Inc., Inc., pursuant to 11 DCMR § 3104.1, for a special exception to continue the operation of a museum by a non-profit organization (last approved by BZA Order No. 16477, dated January 14, 2000), under section 217, in the R-1-B District at premises 1644 31st Street, N.W. and 1670 31st Street, NW (Square 1281, Lots 827 and 830).

16990 - Appeal of American Towers, Inc, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Acting Director of the Department of Consumer and Regulatory Affairs (DCRA) for rescinding Building Permit Nos. B425271, 420358, 429362, et al., relating to the construction of an antenna tower. Appellant alleges that DCRA erred in ruling that a side yard did not meet the minimum requirements under section 775. The subject property is located in the C-2-B District at premises 4623 41st Street, NW (Square 1769, Lots 20 and 30).
