17054 - Appeal of Henry P. Sailer, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator in the issuance of Building Permit No. B448548, to Brian Logan dated January 29, 2003, for the construction of a new single-family detached dwelling. Appellant alleges that the Zoning Administrator erred by issuing the building permit without applying the applicable provisions (subsection 1567, Lot Occupancy and Ground Coverage Restrictions, subsection 1568, Tree Removal Restrictions, etc.) of the Chain Bridge Road/University Terrace Overlay (CBUT). The CBUT/R-1-A zoned subject premises is located at 3101 Chain Bridge Road, N.W. (Square 1427, Lot 870).

17095 - Application of Sun Service, Inc., pursuant to 11 DCMR § 3103.2, for a special exception to allow a parking garage (serving an automobile valet business) under subsections 1403.1 and 1403.2, in the Reed-Cooke/C-2-B District at premises 1701 Kalorama Road, N.W. (Square 2566, Lot 90).

17071 - Application of Edward B. Rooths and Nancy N. Dao, pursuant to 11 DCMR § 3104.1, for a special exception to change a nonconforming use (laundry service) on the basement and 1st floor of a three story apartment house to another nonconforming use (accounting, consulting and tax service business) under section 2003, in the R-5-C District at premises 1312 13th Street, N.W. (Square 243, Lot 12).

17112 - Application of Nancy McKeon, pursuant to 11 DCMR § 3104.1, for a special exception to allow the construction of a one-story addition to a single-family row dwelling under section 223, not meeting the open court requirements (section 406), in the R-3 District at premises 3422 N Street, N.W. (Square 1221, Lot 828).

17113 - Application of Stephen P. McCarron, pursuant to 11 DCMR §3104.1, for a special exception to allow the construction of a two -story rear addition to a single-family detached dwelling under section 223, not meeting the side yard requirements (section 405) at premises 3416 McKinley Street, N.W. (Square 1996, Lot 10).

17110 - Application of Millennium Arts Center, pursuant to 11 DCMR §3103.2, for a variance from the use provisions under subsection 330.5, to operate an Arts Center (artist studios, art exhibitions, and art education) in the former Randall Junior High School building in the R-4 District at premises 65 I Street, S.W. (Square S-643, Lot 801).

17111 - Application of 2412 Limited Partnership, pursuant to 11 DCMR §3103.2, for a variance from the floor area ratio requirements under section 402, a variance from the lot occupancy requirements under section 403, and a variance from the nonconforming structure provisions under subsection 2001.3, to allow a two story addition to an apartment house in the R-5-B District at premises 2412 17th Street, N.W. (Square 2566, Lot 819).

17116 - Application of 1701 18th Street, LLC, pursuant to 11 DCMR § 3101.2, for a variance from the floor area ratio requirements under section 402, a variance from the court width requirements under section 406, a variance from the nonconforming structure provisions under section 2001.3, to allow the conversion of a chancery to an apartment building in the D/DC/R-5-B District at premises 1701 18th Street, N.W. (Square 153, Lot 132).

17115 - Application of Rainbow Lofts, LLC, pursuant to 11 DCMR § 3103.2, for a variance from the residential recreation space requirements under section 773, to allow the development of a 21-unit residential building in the Arts/C-3-A District at premises 1445 Church Street, N.W. (Square 209, Lot 106).

17114 - Application of Ingleside at Rock Creek, pursuant to 11 DCMR § 3104.1, for a special exception to add 13 independent living units in an existing community based residential facility (community residence facility/health care facility) under sections 218 and 219, in the R-1-A District at premises 3050 Military Road, N.W. (Square 2287, Lot 809).

17086 - Appeal of Sheridan Kalorama Neighborhood Council, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of Karen Edwards, General Counsel, Department of Consumer and Regulatory Affairs allowing the transfer of the Jordanian Chancery to the Yemeni Chancery without the approval of the Foreign Mission Board of Zoning Adjustment. The D/R-1-B zoned subject premises is located at 2319 Wyoming Avenue, N.W. (Square 2522, Lot 4).

17109 - Appeal of Kalorama Citizen's Association, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of David Clarke, Director, Department of Consumer and Regulatory from the issuance of Building Permit Nos. B455571 and B455876, dated October 6, 2003, and October 16, 2003, respectively, to Montrose, LLC, to adjust the building height to 70 feet and to revise penthouse roof structure plans to construct a five story apartment house in the R-5-D District. Appellant alleges that the under construction building is in violation of the building height, floor area ratio and roof structure set-back requirements of the Zoning Regulations. The subject property is located at 1819 Belmont Road, N.W. (Square 2551, Lot 45).

17075 - Application of Gorgone Family LP (Chef’s Express Carryout), pursuant to 11 DCMR § 3104.1, for a special exception to allow a convenience store in an apartment house under subsection 354.1, or in the alternative, pursuant to 11 DCMR § 3103.2, a variance from the use provisions to allow a delicatessen/carry-out (no seating) in the DCOD/R-5-E District at premises 1417 17th Street, N.W. (Square 181, Lot 149).

17099 - Application of The Most Worshipful Prince Hall Grand Lodge, pursuant to 11 DCMR § 3104.1, for a special exception to permit open accessory parking spaces under subsection 2116.5, in an R-4 District at premises 1902-1906 Vermont Avenue, N.W. (Square 333, Lots 824, 825 and 827).

17043 - Appeal of Stanton Park Neighborhood Association, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator in the issuance of Certificate of Occupancy Permit Nos. CO51289, and CO51290, to Capitol Hill Healthcare Group dated March 26, 2003, for a community residence facility and hospital (60 beds and 60 parking spaces) respectively. Appellant alleges that the Zoning Administrator erred by issuing the occupancy permits where the proposed use is in violation of the parking requirements. 17085 - Appeal of Larry and Louise Smith and Mary Ann Snow,, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator, et al in the issuance of Building Permit Nos. B424724, B451616, etc., to Chris Doefler and/or Folger Park North, LLC, for the construction of three flats (two family dwellings). Appellant alleges that the Zoning Administrator did not properly apply the provisions of subsection 401.2, etc. The CAP/R-4 zoned subject premises is located at 206, 208, and 210 D Street, S.E. (Square 763, Lots 26, 27 & 28).

17108 - Application of Folger Park North, LLC, pursuant to 11 DCMR §3103.2, for a variance from the lot width and lot area requirements under section 401, to allow the construction of three flats (two-family dwellings) in the CAP/R-4 District at premises 206, 208 and 210 D Street, S.E. (Square 763, Lots 26, 27, and 28).
