17123 - Application of Beech Center, Inc., pursuant to 11 DCMR § 3103.2, for a variance from the lot area requirements under subsection 410.3, to allow the construction of two new single-family detached dwellings in the R-1-B District at premises 3139 and 3143 Westover Drive, S.E. (Square 5664, Lots 70 and 71).

17120 - Application of Alexander Neill, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 932, and a variance from the rear yard requirements under section 933, to allow a rear addition to a single-family row dwelling in the W-1 District at premises 1029 Cecil Place, N.W. 17121 - Appeal of Southeast Citizen’s for Smart Development, Inc., pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of David Clark, Director, Department of Consumer and Regulatory Affairs by letter dated September 18, 2003, granting the construction of a community based residential facility based on a Fair Housing Reasonable Accommodations Request in a C-2-A District at premises 1308, 1310, 1312 and 1314 Potomac Avenue, S.E. (Square 1045, Lots 134, 136, 137, 138).

17109 - Appeal of Kalorama Citizen's Association, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of David Clarke, Director, Department of Consumer and Regulatory from the issuance of Building Permit Nos. B455571 and B455876, dated October 6, 2003, and October 16, 2003, respectively, to Montrose, LLC, to adjust the building height to 70 feet and to revise penthouse roof structure plans to construct a five story apartment house in the R-5-D District. Appellant alleges that the under construction building is in violation of the building height, floor area ratio and roof structure set-back requirements of the Zoning Regulations. The subject property is located at 1819 Belmont Road, N.W. (Square 2551, Lot 45).

17126 - Application of Stephen and Faith Williams, pursuant to 11 DCMR § 3104.1, for a special exception to allow the construction of a two -story rear porch addition to a single family row dwelling under section 223, not meeting the lot occupancy requirements (section 403) in the R-4 District at premises 1418 Columbia Street, N.W. (Square 366, Lot 75 (806)).

17124 - Application of Howard Heu (Parkhill, Inc.), pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 403, and a variance from the off-street parking requirements under subsection 2101.1, to allow the construction of a new flat (two-family dwelling) in the R-4 District at premises 601 Massachusetts Avenue, N.E. (Square 866, Lot 809).

17125 - Application of Krister and Carol Holladay, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 403, to allow the construction of a one story rear addition to a single-family row dwelling in the CAP/R-4 District at premises 507 Independence Avenue, S.E. (Square 843, Lot 20).

17128 - Application of Kathryn Kross, pursuant to 11 DCMR § 3104.1, for a special exception to allow a front porch addition to an existing single-family row dwelling under section 233, not meeting the lot occupancy requirements (section 403), in the R-5-B District at premises 1908 Belmont Road, N.W. (Square 2539, Lot 207).

17099 - Application of The Most Worshipful Prince Hall Grand Lodge, pursuant to 11 DCMR § 3104.1, for a special exception to permit open accessory parking spaces under subsection 2116.5, in an R-4 District at premises 1902-1906 Vermont Avenue, N.W. (Square 333, Lots 824, 825 and 827).

(Square 1032, Lot 14).

17135 - Application of Kenneth H. Bailey, Jr., pursuant to 11 DCMR §3104.1, for a special exception to allow the construction of a roof canopy over an existing stair areaway in the side yard of a single-family detached dwelling under section 223, not meeting the side yard requirements (section 405) in the R-1-B District at premises 4414 Albermarle Street, N.W. (Square 1590, Lot 54).

17130 - Application of James Brady and Neysa Rich, pursuant to 11 DCMR § 3104.1, for a special exception to allow the construction of an accessory garage serving a single family row dwelling under section 223, not meeting the lot occupancy requirements (section 403) and pursuant to 11 DCMR § 3103.2, a variance from the alley centerline setback requirement for an accessory garage under subsection 2300.2 (b) in the R-4 District at premises 407 11th Street, S.E. (Square 972, Lot 7).

17134 - Application of V. Jerome Walker, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 403, a variance from the rear yard requirements under section 404, and a variance from the nonconforming structure provisions under subsection 2001.3, to allow the construction of a two story rear enclosed porch addition to a single-family row dwelling in the R-4 District at premises 163 Adams Street, N.W. (Square 3125, Lot 15).

17133 - Application of Jose I. Reyes (El Tamarindo Restaurant), pursuant to 11 DCMR § 3103.2, for a variance from the floor area ratio requirements under section 771, and a variance from the off-street parking requirements under subsection 2101.1, to expand an existing restaurant’s dining area to the second floor in the C-2-A District at premises 7331 Georgia Avenue, N.W. (Square 2964, Lot 40).

17103 - Application of Stanton Glenn Ltd. Partnership, pursuant to 11 DCMR § 3104.1, for a special exception to allow Child Development Center (60 children, ages infant to 14, and 20 staff) under section 205, (last approved by BZA Order No. 16568, dated May 1, 2000), in the R-5-A District at premises 3040 Stanton Road, S.E. (Square 5879, Lot 11).

17138 - Application of James and Julie Edwards, pursuant to 11 DCMR § 3103.2, for a variance from the minimum lot area requirements under section 401.3, to allow the conversion of an existing flat (two family dwelling) to a four unit apartment building in the R-4 District at premises 1325 Fairmont Street, N.W. (Square 2860, Lot 819).

17136 - Application of Africare, Inc., pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 403, and a variance from the rear yard requirements under section 404, to allow an addition to an existing headquarters office of a charitable organization in the R-4 District at premises 440 R Street, N.W. (Square 509, Lot 805).

17092 - Appeal of Stephanie Mencimer, et al, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of Denzil Noble, Acting Zoning Administrator, Department of Consumer and Regulatory from the issuance of Certificate of Occupancy Number (C of O) CO57903, dated July 23, 2003, to WagTime LLC, a 24-hour dog boarding and grooming with accessory retail sales of pet supplies. Appellant alleges that the aforementioned use is not permitted in the Arts/C-3-A District. The subject property is located at 1412 Q Street, N.W. (Square 209, Lot 878).
