17154 - Application of Bruno Freschi, pursuant to 11 DCMR § 3103.2, for a variance from the lot width and lot area requirements under section 401, a variance from the lot occupancy requirements under section 403, a variance from the rear yard requirements under section 404, and a variance from the height requirement for a building on an alley lot under subsection 2507.4, to allow the construction of a single-family row dwelling in the FBOD/R-3 District at premises rear of 935 26th Street, N.W. (Square 16, Lot 95).

17155 - Application of Ray Hwang and Matthew Depue, pursuant to 11 DCMR § 3103.2, for a variance from the minimum lot area requirements under subsection 401.3, to allow the conversion of a single-family semi-detached dwelling into a four (4) unit apartment house in the R-4 District at premises 3518 10th Street, N.W. (Square 2832, Lot 807).

17075 - Application of Gorgone Family LP (Chef’s Express Carryout), pursuant to 11 DCMR § 3104.1, for a special exception to allow a convenience store in an apartment house under subsection 354.1, or in the alternative, pursuant to 11 DCMR § 3103.2, a variance from the use provisions to allow a delicatessen/carry-out (no seating) in the DCOD/R-5-E District at premises 1417 17th Street, N.W. (Square 181, Lot 149).

17157 - Application of Kirsten Oldenburg, pursuant to 11 DCMR§ 3104.1, for a special exception to allow a two-story rear addition to an existing single-family row dwelling under section 223, not meeting the lot occupancy requirements (section 403), in the R-4 District at premises 423 12th Street, S.E. (Square 992, Lot 62).

17156 - Application of CRP/MR 1414 22nd Street L.P., pursuant to 11 DCMR § 3103.2, for a variance from the recreational space requirements under section 773, to convert and renovate an existing six-story office building with underground parking into a 44 unit apartment house in the DC/C-2-A District at premises 1414 22nd Street, N.W. (Square 48, Lot 806).

17149 - Application of Sidwell Friends School, pursuant to 11 DCMR §3104.1, for a special exception allowing additions and enhancements to an existing private school and to increase enrollment from 780 to 825 students under section 206, in the R-1-B and C-2-A Districts at premises 3825 Wisconsin Avenue, N.W. (Square 1825, Lot 816).

17092 - Appeal of Stephanie Mencimer, et al, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of Denzil Noble, Acting Zoning Administrator, Department of Consumer and Regulatory from the issuance of Certificate of Occupancy Number (C of O) CO57903, dated July 23, 2003, to WagTime LLC, a 24-hour dog boarding and grooming with accessory retail sales of pet supplies. Appellant alleges that the aforementioned use is not permitted in the Arts/C-3-A District. The subject property is located at 1412 Q Street, N.W. (Square 209, Lot 878).

17110 - Application of Millennium Arts Center, pursuant to 11 DCMR §3103.2, for a variance from the use provisions under subsection 330.5, to operate an Arts Center (artist studios, art exhibitions, and art education) in the former Randall Junior High School building in the R-4 District at premises 65 I Street, S.W. (Square S-643, Lot 801).

17159 - Application of Michael and Catherine Ryan, pursuant to 11 DCMR § 3104.1, for a special exception to allow a rear addition to an existing single family semi-detached dwelling under section 223, not meeting the side yard requirements (section 405), in the R-1-B District at premises 5104 Sherrier Place, N.W. (Square 1415, Lot 29).

17158 - Application of JBG/Rockwood 1101 K, LLC, pursuant to 11 DCMR § 3104.1, to reduce the number of required parking spaces (from 161 spaces to 121 spaces) by twenty five percent (25%) under section 2108, serving a proposed mixed use office/retail building in the DD/C-2-C and DD/C-3-C District at premises 1101 K Street, N.W. (Square 316, Lots 817 and 818).

17164 - Application of St. Patrick’s Protestant Episcopal Church, pursuant to 11 DCMR § 3104.1, for a special exception limited to the modification of approved private school plans (last approved by BZA Order No. 16852) to allow the use of a portion of the basement for classroom purposes under section 206 (no change in the governing cap on students and staff is proposed) in the R-1-B District at premises 4925 MacArthur Boulevard, N.W. (Square 1393, Lot 17 (823)).

17085 - Appeal of Larry and Louise Smith and Mary Ann Snow, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator, et al in the issuance of Building Permit Nos. B424724, B451616, etc., to Chris Doefler and/or Folger Park North, LLC, for the construction of three flats (two family dwellings). Appellant alleges that the Zoning Administrator did not properly apply the provisions of subsection 401.2, etc. The CAP/R-4 zoned subject premises is located at 206, 208, and 210 D Street, S.E. (Square 763, Lots 26, 27 & 28).

17148 - Application of Marshall Heights Community Development Organization, pursuant to 11 DCMR § 3103.2, for a variance from the side yard requirements under section 405, to allow the construction of a single-family detached dwelling in the R-1-B District at premises 3034 Clinton Street, N.E. (Square 4319, Lot 72).

17161 - Application of Chiswell D. Langhorne, Jr., pursuant to 11 DCMR § 3104.1, for a special exception to allow a second story glass enclosed (conservatory) addition to an existing single family detached dwelling under section 223, not meeting the side yard requirements (section 405) in the R-1-B District at premises 1680 31st Street, N.W. (Square 1281, Lot 31).

17162 - Application of Jim and Mary Bennett, pursuant to 11 DCMR § 3104.1, for an addition to an existing accessory structure connecting to the principal structure (a single family row dwelling) under section 223, not meeting the lot occupancy requirements (section 403), the rear yard requirements (section 404), the closed court requirements (section 406) and the nonconforming structure requirements (subsection 2001.3), in the R-3 District at premises 1557 33rd Street, N.W. (Square 1272, Lot 872).

17160 - Application of Northwest Settlement House, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 403, a variance to increase the matter-of-right capacity of an existing child development center from 16 to 40 children under subsection 330.5(d), and a variance from the off-street parking requirements under subsection 2101.1, or in the alternative pursuant to 11 DCMR § 3104.1, a special exception to allow a child development center (40 children and 12 staff) under section 205, in the R-4 District at premises 448 Ridge Street, N.W. (Square 513, Lots 825, 826, 827 and 828).

17055 - Application of Army Distaff Foundation, Inc., pursuant to 11 DCMR § 3104.1, for a special exception to allow a four story addition housing 25 nursing rooms accommodating 27 residents and the addition of 27 independent living units under section 219 at the Knollwood Army Retirement Residence, an existing health care facility, in the R-1-A District at premises 6200 Oregon Avenue, N.W. (Square 2339, Lot 3).

17127 - Appeal of Nebraska Avenue Neighborhood Association, pursuant to 11 DCMR §§ 3100 and 3112, from the administrative decision of the Acting Zoning Administrator, Department of Consumer and Regulatory Affairs (DCRA) for the issuance of multiple building permits, allowing the construction of a community residence facility (assisted living facility). Appellant alleges that DCRA erred by issuing the building permits as the under construction building is in violation of several zoning requirements including rear yard, FAR, roof structure, building height, parking, etc. The subject property is located in the R-2 and R-5-B Districts at premises 5111 Connecticut Avenue, N.W. (Square 1989, Lot 162).
