17109 - Appeal of Kalorama Citizens Association, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of David Clarke, Director, Department of Consumer and Regulatory from the issuance of Building Permit Nos. B455571 and B455876, dated October 6, 2003, and October 16, 2003, respectively, to Montrose, LLC, to adjust the building height to 70 feet and to revise penthouse roof structure plans to construct a five story apartment house in the R-5-D District. Appellant alleges that the under construction building is in violation of the building height, floor area ratio and roof structure set-back requirements of the Zoning Regulations. The subject property is located at 1819 Belmont Road, N.W. (Square 2551, Lot 45). 17260 - Application of 2224 R Street, LLC, pursuant to 11 DCMR § 3104.1, for a special exception to establish a 10 room bed and breakfast as a home occupation under subsection 203.10, and modifications under subsection 203.10(b), to allow 10 sleeping rooms (subsection 203.8(c)(1), and to allow more than 8 clients/customers on the premises in any one hour period (subsection 203.4(m), in the D/R-3 District at premises 2224 R Street, N.W. (Square 2512, Lot 13). 17270 - Application of Thomas & Kathryn Toggas, pursuant to 11 DCMR § 3104.1, for a special exception to allow an addition to an existing single-family semi-detached dwelling under section 223, not meeting the side yard (section 405) requirements in the R-1-B District at premises 3112 Legation Street, N.W. (Square 2293, Lot 835). 17290 - Application of IDS-DC, Inc. (Minor Modification of 16860), pursuant to 11 DCMR § 3129.1, for a modification of plans approved under BZA Order No. 16860, dated May 1, 2002, to allow a second story (approx. 150 sq. ft.) addition to an existing row dwelling in the R-4 District at premises 274 Kentucky Avenue, S.E. (Square 1039, Lot 81). 17277 - Application of Sabrina G. Wright, pursuant to 11 DCMR § 3104.1, for a special exception to allow a rear addition to an existing single-family semi-detached dwelling under section 223, not meeting the side yard requirements (section 405), in the R-1-B District at premises 1916 Newton Street, N.E. (Square 5145-S, Lots 17 and 18) 17279 - Application of Stephanie Peters and Charles Fishman, pursuant to 11 DCMR § 3103.1, for a variance from the floor area ratio requirements under section 402, and pursuant to 11 DCMR §3104.1, for a special exception to allow a two-story rear addition to an existing single-family row dwelling under section 223, not meeting the lot occupancy (section 403) and rear yard (section 404) requirements, in the R-5-B District at premises 2604 Mozart Place, N.W. (Square 2579, Lot 19). 17232 - Application of RLA Revitalization Corporation (DC USA), pursuant to 11 DCMR § 3104.1, for a special exception from the roof structure requirements under section 411, and pursuant to 11 DCMR § 3103.2, for a variance from the off-street parking requirements under subsection 2101.1, to permit a multi-use commercial establishment in the C-3-A District at premises 1400-1420 Park Road, N.W., 3100-3220 14th Street, N.W., and 1417-1437 Irving Street, N.W. (Square 2674, Lots 719, 720, 812, 832, 863, 866, 869, 870, 871, and 872). 17283 - Application of Julia Jones and Jason Pugh, pursuant to 11 DCMR § 3104.1, for a special exception to allow a rear addition to an existing flat (two-family) row dwelling under section 223, not meeting the lot occupancy requirements (section 403), in the CAP/ R-4 District at premises 429 1st Street, S.E. (Square 5985, Lot 818). 17281 - Application of Power Fuel and Transport LLC, pursuant to 11 DCMR § 3104.1, for a special exception to re-establish a gasoline service station under subsections 743.1 and 2302.1, in the C-3-A District at premises 4675 South Capitol Street, S.W. (Square 6274, Lots 1 and 4). 17282 - Application of DAG Real Estate Holding Company LLC, pursuant to 11 DCMR § 3104.1, for a special exception to enlarge a gasoline service station /mini-mart store under sections 726.1 and 2302, and a special exception to establish a fast-food restaurant in an adjoining structure under subsection 733.1, in the C-2-A District at premises 3101-3103 Rhode Island Avenue, N.E. (Square 4308, Lot 45). 17232 - Application of RLA Revitalization Corporation, pursuant to 11 DCMR § 3104.1, for a special exception from the roof structure requirements under section 411, and pursuant to 11 DCMR § 3103.2, for a variance from the off-street parking requirements under subsection 2101.1, to permit a multi-use commercial establishment in the C-3-A District at premises 1400-1420 Park Road, N.W., 3100-3220 14th Street, N.W., and 1417-1437 Irving Street, N.W. (Square 2674, Lots 719, 720, 812, 832, 863, 866, 869, 870, 871, and 872). 17286 - Application of Grace Guggenheim, pursuant to 11 DCMR § 3104.1, for a special exception to allow additions to an existing single-family semi-detached dwelling under section 223, not meeting the lot occupancy (section 403), rear yard (section 404), side yard (section 405), and nonconforming structure provisions (subsection 2001.3) in the R-3 District at premises 2912 Cortland Place, N.W. (Square 2103, Lot 60). 17287 - Application of Robin Epstein, pursuant to 11 DCMR § 3104.1, for a special exception to construct a two-story rear addition to an existing single-family row dwelling under section 223, not meeting the lot occupancy (section 403) and rear yard (section 404) requirements in the R-4 District at premises 1542 1st Street, N.W. (Square 552, Lot 199). 17284 - Application of Miranda R. Brown, pursuant to 11 DCMR § 3103.2, for a modification of plans under subsection 3125.8, for a four story single-family detached dwelling, that was approved under BZA Application No. 16929, dated November 22, 2002. The requested modification will allow the construction of a three-story single-family detached dwelling with mezzanine, in the R-1-B District, at premises 3120 Pennsylvania Avenue, S.E. (Square 5545, Lot 3). 17270 - Application of Thomas & Kathryn Toggas, pursuant to 11 DCMR § 3104.1, for a special exception to allow an addition to an existing single-family semi-detached dwelling under section 223, not meeting the side yard (section 405) requirements in the R-1-B District at premises 3112 Legation Street, N.W.
