16839 - Appeal of Advisory Neighborhood Commission 4A, pursuant to 11 DCMR §§ 3100 and 3101 from the decision of the Zoning Administrator, for the issuance of a certificate of occupancy (#18366, dated August 31, 2001) for an elderly development center serving 30 persons, ages 22-85 years old and 7 staff in a C-2-A District at premises 5511 14th Street, N.W. (Square 2800, Lot 9). 17381 - Application of AMM Development Inc., pursuant to 11 DCMR § 3104.1, for a special exception to permit new residential development (4 row dwellings) under section 353, and for multiple buildings to be considered a single building under section 410, in the R-5-A District at premises 1400 block (north side) of Rock Creek Ford Road, N.W., between Fort Stevens Drive, N.W. and 14th Street, N.W. (Square 2726, Lot 810). 17393 - Application of Ellis Denning Properties LLC on behalf of Ernest L. Murphy, pursuant to 11 DCMR Section 3103.2, for a variance from the residential recreation space requirement under section 773 to allow the construction of a twenty (2) unit apartment addition in the C-2-A District at premises 1425 11th Street, N.W. (Square 338, Lots 37, 38, 39, 40, 800, 801, 802 and 803). 17388 - Application of Taylor Property Development LLC, pursuant to 11 DCMR § 3103.2, for a variance from the nonconforming structure provisions under subsection 2001.3, to permit the renovation and addition to an existing apartment house, not meeting the lot occupancy requirements (section 403) and open court requirements (section 406), in the R-4 District at premises 1360 Kenyon Street, N.W. (Square 2848, Lot 44). 17109 - Appeal of Kalorama Citizen’s Association, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of David Clarke, Director, Department of Consumer and Regulatory from the issuance of Building Permit Nos. B455571 and B455876, dated October 6, 2003, and October 16, 2003, respectively, to Montrose, LLC, to adjust the building height to 70 feet and to revise penthouse roof structure plans to construct a five story apartment house in the R-5-D District. Appellant alleges that the under construction building is in violation of the building height, floor area ratio and roof structure set-back requirements of the Zoning Regulations. The subject property is located at 1819 Belmont Road, N.W. (Square 2551, Lot 45). 17384 - Application of the Embassy of the Republic of Moldova, pursuant to § 1002, to permit the replacement of wood windows with vinyl window in the C-3-C District at premises 2101 S Street, N.W. (Sheridan-Kalorama Historic District) (Square 2532, Lot 37). 17398 - Application of Jason Lefebure, pursuant to 11 DCMR § 3103.2, for a variance from the floor area ratio requirements under subsection 1321.2, (proposed H Street N.E. Commercial Overlay District – ZC Case No. 04-27) and a variance from the rear yard requirements under section 774, to allow the renovation of and third floor addition to an existing building for commercial use in the HS/C-2-A District at premises 510 H Street, N.E. (Square 832, Lot 14). 17399 - Application of Lot 74 LLC and Vasal Jahanbin, pursuant to DCMR §§ 3103.2 and 3104.1, for a special exception under § 2514.2, to allow the regulations applicable to that portion of a lot in a lesser restrictive use zone district to be extended to that portion of the lot in a more restrictive use zone district, a special exception under § 2108 to reduce the amount of parking required for a commercial portion of the development by no more than 25%, a special exception under § 214 to locate accessory parking spaces elsewhere than on the same lot on which the primary use is located, a special exception under § 411.11, from the roof structure setback requirements, and a variance from the R-4 minimum lot area requirement under § 401.3, to allow the construction of a commercial building and two flats, with accessory parking in the Arts/C-2-A District and the R-4 District at premises 1939 12th Street, N.W. (Square 305, Lots 72, 73 and 74). 17400 - Application of Peter and Katherine Powers, pursuant to 11 DCMR §§ 1202.1 and 3104.1, for a special exception to construct a rear addition to an existing single-family row dwelling under section 223, not meeting the court requirements (section 406) in the CAP/R-4 District at premises 325 A Street, S.E. (Square 788, Lot 38). 17405 - Application of MacArthur Laverock LLC, on behalf of Cathie E. and Philip C. Guzzetta, pursuant to 11 DCMR § 3104.1, for a special exception to permit an addition to a single-family detached dwelling under section 223, not meeting the rear yard requirements (section 404) in the R-5-A District at premises 4598 Laverock Place, N.W. (Square 1356, Lot 36). 17404 - Application of Wilbur Mondie, pursuant to 11 DCMR § 3103.2, for a variance from the lot width and lot area requirements under section 401.3, to allow the construction of four flats (two-family dwellings) in the R-4 District at premises 410, 412, 414 and 416 Richardson Place, N.W. (Square 507, Lots 810, 812, 814 and 816). 17304 - Application of Washington Metropolitan Area Transit Authority (WMATA), pursuant to 11 DCMR § 3104.1, for special exceptions to allow construction of an office building, not meeting the parking requirements under section 2107, not meeting the roof structure setback requirements under subsection 411.11, and a parking lot under section 213, in the C-3-A and R-2 Districts at premises 4500 Benning Road, N.E. (Square 1089, Lot 58). 17413 - Application of Bill and Kim Alms, pursuant to 11 DCMR § 3104.1, for a special exception to allow the construction of a one-story rear addition to an existing single-family row dwelling under section 223, not meeting the court requirements (section 406), in the R-3 District at premises 3317 N Street, N.W. (Square 1229, Lot 129). 17407 - Application of Kesher Israel Congregation, pursuant to 11 DCMR § 3104.1, for a special exception to establish a child development center (nursery school - 24 children, ages 2 to 5, and 8 staff, Monday through Friday, 7:00 AM to 6:00 PM) under section 205, in the R-3 District at premises 2801 N Street, N.W., 1308 and 1310 28th Street, N.W. (Square 1235, Lots 160, 161 and 800). 17402 - Application of Karl H. Lass Family Trust, pursuant to 11 DCMR § 3103.2, for a variance from the residential recreation space requirement under section 773, and a variance from the area and width requirements for a closed court under section 776, to allow an addition to an existing multiple dwelling in the C-2-C District at premises 1109 M Street, N.W. (Square 314, Lot 3). 17403 - Application of Walnut Street LLC, on behalf of 917 M Street LP c/o Philip Abraham, pursuant to 11DCMR §§ 3103.2 and 3104.1, for a special exception from the roof structure enclosing wall equal height requirement under subsection 411.11, a variance from the lot occupancy requirement under section 772, and a variance from the residential recreation space requirement under subsection 773.3, to allow the construction of an apartment building in the C-2-A District at premises 917 M Street, N.W. (Square 368, Lot 900). 17356 - Appeal of Bannum, Inc., pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator, Department of Consumer and Regulatory Affairs (DCRA) for the revocation of Certificate of Occupancy Permit No. C53679, dated May 2, 2003, for a temporary correctional institution. Appellant alleges that DCRA erred by revoking the occupancy permit. The subject property is located in the C-M-2 District at premises 2210 Adams Place, N.E. (Square 4259, Parcel 154/81). |
