17285 - Appeal of Patrick J. Carome, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator of the Department of Consumer and Regulatory Affairs. Appellant alleges that the Zoning Administrator erred by issuing a Building Permit (No. B460927, dated April 23, 2004) allowing the construction of a masonry retaining wall serving a single-family detached dwelling. Appellant contends that the retaining wall violates the Zoning Regulations, including the side yard requirements (section 405), rear yard requirements (section 404), and structures in open space requirements (section 2503). The subject premise is located within the Tree and Slope/Wesley Heights/R-1-A District and is located at 4825 Dexter Terrace, N.W. (Square 1381, Lot 806). continued from 3/10/05 and 3/15/05.

17301 - Application of George Giagtzoglou and Sarah Simmons, pursuant to 11 DCMR § 3104.1, for a special exception to allow a side addition to an existing single-family detached dwelling under section 223, not meeting the side yard (section 405) requirements in the R-1-B District at premises 5717 Chevy Chase Parkway, N.W. (Square 1999, Lot 78).

17303 - Application of Thomas Stehle, pursuant to 11 DCMR § 3104.1, for a special exception to allow a rear porch addition to an existing flat under section 223, not meeting the lot occupancy (section 403), open court (section 406) and nonconforming structure (subsection 2001.3) requirements in the R-4 District at premises 1223 Girard Street, N.W. (Square 2856, Lot 35).

17302 - Application of Non-Profit Community Development Corporation of D.C. (NPCDC), pursuant to 11 DCMR § 3103.2, for a variance from the maximum height requirements under subsection 770.1, to construct a new 7 story apartment (condominium) building with ground floor commercial in the C-2-B District at premises 2750 14th Street, N.W. (Square 2667, Lot 73 (849)).

17300 - Application of St. Patrick’s Protestant Episcopal Church, pursuant to 11 DCMR § 3104.1, for a special exception to allow an increase in the student enrollment at a private school (last approved under BZA Order No. 16852-A), from 40 to 60 children, under section 206, in the R-1-B District at premises 4925 MacArthur Boulevard, N.W. (Square 1393, Lot 17).

17449 - Appeal of Advisory Neighborhood Commission 1C, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator, Department of Consumer and Regulatory Affairs (DCRA) to issue Building Permit No. B474628, dated June 9, 2005, allowing alterations to an existing 16 unit apartment building. Appellant alleges that the alterations to the building violates the floor area ratio (section 402), lot occupancy (section 403) and nonconforming structure (subsection 2001.3) requirements. The subject property is located in the R-5-B District at premises 1825 Vernon Street, N.W. (Square 2555, Lot 5.)

17306 - Application of Hannah Reisman, pursuant to 11 DCMR §§ 1202 and 3104.1, for a special exception to allow an addition to an existing single-family dwelling, not meeting the rear yard requirements (section 404), in the CAP/R-4 District at premises 227 C Street, S.E. (Square 763, Lot 24).

17307 - Application of Nicholas Baker, pursuant to 11 DCMR § 3103.2, for variances from the floor area ratio requirements (section 402), the lot occupancy requirements (section 403), the rear yard requirements (section 404), and nonconforming structure provisions (subsection 2001.3), to allow a third story addition to an existing single-family row dwelling in the R-5-B District at premises 978 Florida Avenue, N.W. (Square 357, Lot 100).

17304 - Application of Washington Metropolitan Area Transit Authority (WMATA), pursuant to 11 DCMR § 3104.1, for special exceptions to allow construction of an office building, not meeting the parking requirements under section 2107, not meeting the roof structure setback requirements under subsection 411.11, and providing accessory parking on adjacent residentially zoned property under section 214, in the C-3-A and R-2 Districts at premises 4500 Benning Road, N.E.
