Klein, pursuant to 11 DCMR § 3104.1, for a special exception to continue the use of an accessory parking lot under sections 213 and 2303 (the parking lot was lasted approved under BZA Order No. 16659, dated June 13, 2001), in the R-1-B District at premises 4418-4420 Connecticut Avenue, N.W. (Square 1971, Lot 825).

17519 - Appeal of Advisory Neighborhood Commission 2E, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator (ZA), Department of Consumer and Regulatory Affairs (DCRA) to issue Building Permit No. 89770, allowing conversion of an existing single-family semi-detached dwelling into a row dwelling. Appellant alleges that issuance of the permit violated the lot occupancy (section 403) provisions of the Zoning Regulations and that the ZA should have required the BZA approval for the conversion. The subject property is located in the R-3 District at premises 1812 35th Street, N.W. (Square 1296, Lot 802).

17526 - Appeal of Advisory Neighborhood Commission 6A, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator (ZA), Department of Consumer and Regulatory Affairs (DCRA) to issue Building Permit allowing conversion of an existing single-family row dwelling into a flat (two-family dwelling). Appellant alleges that issuance of the permit violates the off-street parking requirements under sections 2100.4, 2100.6, 2100.7, 2100.9, 2101.1, and 2115.6 of the Zoning Regulations. Appellant also alleges that a rear addition violates several R-4 area requirements, including sections 403 and 404. The subject property is located in the R-4 District at premises 1411 Ames Place, N.E. (Square 1056, Lot 39).

17535 - Application of Ann Goodman, pursuant to 11 DCMR § 3104.1, for a special exception to allow the construction of an addition (covered walkway) connecting an existing single-family detached dwelling to an existing accessory garage under section 223, not meeting the rear yard requirements (section 404), in the R-3 District at premises 3254 O Street, N.W. (Square 1230, Lot 125).

17534 - Application of 1024 Pennsylvania Ave. LLC, pursuant to 11 DCMR § 3103.2, for a variance from the residential recreation space requirements under section 773, to allow the development of a multi-family residential building in the CHC/C-2-A District at premises 1022 Pennsylvania Avenue, S.E. (Square 972, Lot 67).

17536 - Application of Thomas J. Synhorst and Ben J. Kozlowski, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 403, a variance from the rear yard requirements under section 404, and a variance from the nonconforming structure provisions under subsection 2001.3, to allow the construction of a rear deck to a single-family row dwelling in the DC/R-5-B District at premises 1405 21st Street, N.W. (Square 96, Lot 803).

17539 - Application of Istiqomah Knights, pursuant to 11 DCMR § 3104.1, for a special exception to allow a front porch enlargement and rear deck addition to an existing single-family row dwelling under section 223, not meeting the lot occupancy requirements (section 403) in the R-4 District at premises 619 Orleans Place, N.E. (Square 855, Lot 363).

17537 - Application of Victor Tabbs, pursuant to 11 DCMR § 3103.2, for a variance from the limitation on the number of stories under subsection 400.1, to construct a four (4) story rear addition to a flat (two-family dwelling) at premises 714 13th Street, S.E. (Square 1045, Lot 97).

17521 - Application of 601-645 H Street Ventures LLC, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 772, and pursuant to 11 DCMR § 3104.1, special exception from the ground floor level ceiling height provisions to allow the construction of a new mixed-use (residential and commercial) building on a lot that has six-thousand square feet or more of land under subsections 1320.4 and 1325, in the H Street Northeast Neighborhood Commercial overlay District in the HS/C-2-A and HS/C-2-C Districts at premises 601-645 H Street, N.E. (Square 859, Lot 177).

17532 - Appeal of AppleTree Institute for Education Innovation, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator (ZA), Department of Consumer and Regulatory Affairs (DCRA) to require BZA special exception approval for a proposed addition to an existing public charter school. Appellant also alleges that the ZA erroneously relied upon the Zoning Commission’s 2/13/06 emergency rulemaking to require additional on-site parking spaces. The subject property is located in the R-4 District at premises at 138 12th Street, N.E. (Square 988, Lot 820).

17540 - Application of Capitol Hill Day School, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 404, a variance from the rear yard requirements under section 403, and a variance from the parking requirements under subsection 2117.2, and pursuant to 11 DCMR §§ 1202.1 and 3104.1, a special exception to allow the construction of an addition to a private school under section 206, in the CAP/R-4 District at premises 210 South Carolina Avenue, S.E. (Square 765, Lot 803).

17541 - Application of Capitol Hill Day School, pursuant to 11 DCMR §§ 1202.1 and 3104.1, a special exception to allow the continued operation of a private school for thirty (30) students in pre-kindergarten through eighth grade and five (5) faculty and staff members in the basement through the second floor under section 206, in the CAP/R-4 District at premises 214 South Carolina Avenue, S.E. (Square 765, Lot 802).

17533 - Appeal of Advisory Neighborhood Commission 6A,, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator (ZA), Department of Consumer and Regulatory Affairs (DCRA) to issue Building Permit No. B98956 approving the construction of a three (3) unit apartment house. Appellant alleges that the apartment use is in violation of several sections of 11 DCMR, including subsections 330.5, 401.3, and 2101.1. The subject property is located in the R-4 District at premises at 1405 North Carolina Avenue, N.E. (Square 1056, Lot 88).
