Prior to the Board's meeting, the ANC did not receive DDOT's memo and the Applicant received it hours before the meeting. The Board indicated that time would be given to the parties to review the document.

Creighton-Cabezas, pursuant to 11 DCMR § 3104.1, for a special exception to allow a three-story rear addition to an existing single-family detached dwelling under section 223, not meeting the lot occupancy requirements (section 403), rear yard requirements (section 404), and side yard requirements (section 405), in the R-1-B District at premises 4508 Van Ness Street, N.W. (Square 1560, Lot 28).

17443 - Application of Allstate Hotel Partnership, pursuant to 11 DCMR §§ 3103.2 and 3104.1, for a special exception to permit a hotel under section 512, and a special exception with regards to the number and setbacks of roof structures under section 411, and a variance to permit a roof top pool enclosure above the permitted height under section 530, to construct a hotel in the SP-2 District at premises 515 20th Street, N.W. 17441 - Application of JPI Development Services L.P., pursuant to 11 DCMR 3103.2 and 3104.1, for variance relief from Section 773 of the Zoning Regulations to permit less than the required residential recreation space and a special exception for multiple roof structures pursuant to Section 411 of the Zoning Regulations to allow the development of a multiple family residential building at premises 70 and 100 Eye Street, S.E. (Square 695, Lot 816).

17446 - Application of Pauline S. Ney, pursuant to 11 DCMR § 3104.1, for variances from the floor area ratio requirements under section 402, lot occupancy requirements under section 403, rear yard requirements under section 404, and nonconforming structure provisions under subsections 2001.3 and 2002.4, to construct six residential units above existing one-story retail structures in the R-5-B District at premises 2160-2162 California Street, N.W. (Square 2530, Lots 99 and 100).

17434 - Appeal of Stanton Park Neighborhood Association, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator, Department of Consumer and Regulatory Affairs (DCRA) to issue Certificate of Occupancy (C of O) Permit No. 93212, dated March 10, 2005, authorizing a change of ownership for a carryout (Taste of Jamaica) restaurant. Appellant alleges that DCRA erred by issuing the C of O for a carryout without Board of Zoning Adjustment special exception review as a fast food restaurant under subsection 733. The subject property is located in the HS (H Street Northeast Commercial Overlay)/C-2-A District at premises 528 H Street, N.E. (Square 832, Lot 90).

17431 - Application of King’s Creek LLC, pursuant to 11 DCMR § 3104.1 and 3103.2, for a special exception to allow a building height of 50 feet in the Reed Cooke Overlay under section 1403, and a variance to permit an addition to a nonconforming structure under subsection 2001.3, a variance from the floor area ratio requirements under subsection 402, and a variance from the court requirements under section 406, to allow an addition to and conversion of an existing building for residentially use in the RC/R-5-B District at premises 2329 and 2335 Champlain Street, N.W. (Square 2563, Lots 103 and 816).

17447 - Application of 2142 O Street LLC, pursuant to 11 DCMR § 3103.2, for a variance from the floor area ratio requirements under subsection 402.4, and a variance from the nonconforming structure provisions under subsection 2001.3, to allow the enlargement of an existing vacant former apartment building from 10 units to 8-9 condominium units in the DC/R-5-B District at premises 2142 O Street, N.W. (Square 69, Lot 218).

17450 - Application of James Fife and Catherine McCulloch, pursuant to 11 DCMR § 3104.1, for a special exception to allow a rear addition to an existing single-family row dwelling under section 223, not meeting the lot occupancy requirements (section 403) and nonconforming structure provisions (subsection 2001.3) in the R-4 District at premises 614 A Street, N.E. (Square 867, Lot 97).

17451 - Application of Richard E. Cytowic, pursuant to 11 DCMR § 3104.1, for a special exception to allow a second story addition above an existing attached garage serving a single-family detached dwelling under section 223, not meeting the rear yard requirements (section 404), in the R-1-B District at premises 4720 Blagden Terrace, N.W. (Square 2656, Lot 36).

17433 - Application of Access Housing, Inc., pursuant to 11 DCMR § 3104.1, for a special exception to establish emergency shelters (totaling ninety-one (91) beds) for homeless veterans in two abutting, former apartment buildings under sections 358 and 360, in the R-5-A District at premises 820 and 838-842 Chesapeake Street, S.E. (Square 6160, Lots 89 and 872).

17430 - Appeal of Rodut Associates of DC LP, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator, Department of Consumer and Regulatory Affairs (DCRA) to issue Certificate of Occupancy (C of O) Permit No. 100692, dated July 5, 2005, authorizing the use of an apartment building. Appellant alleges that DCRA erred by issuing the C of O for two principal structures on a single lot in violation of 11 DCMR § 3202.2. The approved DCRA construction plans show a yet to be built above ground connection between the two buildings. The subject property is located in the DD/C-3-C District at premises 1150 K Street, N.W. (Square 317, Lot 25).
