17439 - Appeal of Advisory Neighborhood Commission 6A, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator, Department of Consumer and Regulatory Affairs (DCRA) to issue Certificate of Occupancy (C of O) Permit No. 102037, dated July 27, 2005, authorizing a 49 seat restaurant use (“Cluck-U-Chicken”) Appellant alleges that DCRA erred by issuing the C of O for a fast food restaurant without Board of Zoning Adjustment special exception review under subsection 733. The subject property is located in the HS (H Street Northeast Commercial Overlay)/C-2-A District at premises 1123 H Street, N.E. (Square 982, Lot 823).

17383 - Application of The Lab School of Washington, pursuant to 11 DCMR § 3104.1, for special exceptions to permit an increase in faculty and staff to from 94 to 190, and an increase in student enrollment from 310 to 330, at 4759 Reservoir Road, N.W. and to permit the use of 4749 Whitehaven Parkway for administrative offices under section 206, and for accessory parking spaces for an existing private school under section 214, in the R-1-B District at premises 4749 Whitehaven Parkway, N.W. and 4759 Reservoir Road, N.W. 17481 - Application of the Republic of Hungary, pursuant to 11 DCMR §1002.1 and §206(b)(2)(B) of the Foreign Missions Act, to expand and renovate an existing chancery building in the R-1-A and R-5-D Districts at premises 3900 Shoemaker Street, N.W. (Square 2231, Lot 3) and 2950 Linnean Avenue, N.W. (a/k/a Spring of Freedom Street, N.W.) (Square 2231, Lot 6).

17309 - Application of Dorchester Associates LLC, pursuant to 11 DCMR § 3104.1, for a special exception under section 2516, to allow thirteen detached single-family dwellings on a single subdivided lot, including approval of two sixteen foot wide roadways rather than twenty-five foot wide roadways under subsection 2516 (d), in the CBUT/R-1-A District in the 2800 block of Chain Bridge Road, N.W. (Square 1425, Lot 827, Parcels 12/63, 12/293 and 12/294).

17443 - Application of Allstate Hotel Partnership, pursuant to 11 DCMR §§ 3103.2 and 3104.1, for a special exception to permit a hotel under section 512, and a special exception with regards to the number and setbacks of roof structures under section 411, and a variance to permit a roof top pool enclosure above the permitted height under section 530, to construct a hotel in the SP-2 District at premises 515 20th Street, N.W. (Square 122, Lot 25).

17456 - Application of Jubilee Housing Inc., pursuant to 11 DCMR § 3103.2, for a variance from the off-street parking requirements under subsection 2101.1, and pursuant to 11 DCMR § 3104.1, for a special exception to allow a child development center (50 Children and 16 Staff) under section 205, in the R-5-B District at premises 2525 Ontario Road, N.W. 17458 - Application of Johnson Memorial Baptist Church, pursuant to 11 DCMR § 3103.2, for a variance to allow church programs not conducted within an existing church building under subsection 216.3, and pursuant to 11 DCMR § 3104.1, a special exception to allow the use of an existing building for church programs (Sunday school classes and a computer training program) under section 216, in the R-2 District at premises 746 Ridge Road, S.E. (Square 5388, Lot 51).

17454 - Application of Brookland Union Baptist Church, pursuant to 11 DCMR § 3104.1, for a special exception to establish an accessory parking lot (24 spaces) serving a church under section 214 and 2116.5, and pursuant to 11 DCMR § 3103.2, a variance to allow the accessory parking spaces to be located over 200 feet away from the principal church use under subsection 214.3, in the R-1-B District at premises 1419 Jackson Street, N.E. (Square 4015, Lot 30).

17449 - Appeal of Advisory Neighborhood Commission 1C, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator, Department of Consumer and Regulatory Affairs (DCRA) to issue Building Permit No. B474628, dated June 9, 2005, allowing alterations to an existing 16 unit apartment building. Appellant alleges that the alterations to the building violates the floor area ratio (section 402), lot occupancy (section 403) and nonconforming structure (subsection 2001.3) requirements. The subject property is located in the R-5-B District at premises 1825 Vernon Street, N.W. (Square 2555, Lot 5.)

17457 - Application of 3DG/3400 11th Street LLC, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 772, a variance from the residential recreation space requirements under section 773, a variance from the rear yard requirements under section 774, a variance from the closed court requirements under section 776, and a variance from the off-street parking requirements under subsection 2101.1, to allow the construction of an eleven (11) unit apartment building in the C-2-A District at premises 3400 11th Street, N.W. (Square 2839, Lot 121).

17446 - Application of Pauline S. Ney, pursuant to 11 DCMR § 3104.1, for variances from the floor area ratio requirements under section 402, lot occupancy requirements under section 403, rear yard requirements under section 404, and nonconforming structure provisions under subsections 2001.3 and 2002.4, to construct six residential units above existing one-story retail structures in the R-5-B District at premises 2160-2162 California Street, N.W. (Square 2530, Lots 99 and 100).

17460 - Application of G.K.D. 1412 Chapin Street LLC, pursuant to 11 DCMR § 3103.2, for a variance from the height limitations under section 400, a variance from the floor area ratio requirements under section 402, a variance from the lot occupancy requirements under section 403, and a variance from the rear yard requirements under section 404, to construct a new 31 unit apartment building in the R-5-B District at premises 1412 Chapin Street, N.W. (Square 2661, Lot 152).

17444 - Appeal of Kuri Brothers, Inc., pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator, Department of Consumer and Regulatory Affairs (DCRA) to revoke Certificate of Occupancy (C of O) Permit Nos. 33951 and 33914 (for an automobile service center & vehicle fueling) by Notice of Revocation dated August 4, 2005. The subject property is located in the C-3-A District at premises 4221 and 4225 Connecticut Avenue, N.W. (Square 2051, Lot 5.)
