17439 - Appeal of Advisory Neighborhood Commission 6A, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator, Department of Consumer and Regulatory Affairs (DCRA) to issue Certificate of Occupancy (C of O) Permit No. 102037, dated July 27, 2005, authorizing a 49 seat restaurant use (“Cluck-U-Chicken”) Appellant alleges that DCRA erred by issuing the C of O for a fast food restaurant without Board of Zoning Adjustment special exception review under subsection 733. The subject property is located in the HS (H Street Northeast Commercial Overlay)/C-2-A District at premises 1123 H Street, N.E. (Square 982, Lot 823).

17459 - Application of DC Hampton LLC, pursuant to 11 DCMR § 3103.2, for a variance from the residential recreation space requirements under section 773, to allow the construction of a 28 unit multiple dwelling in the Arts/C-3-A District at premises 1446-1454 Church Street, N.W. (Square 209, Lots 911 and 917).

17464 - Application of Sherman Arms LLC, pursuant to 11 DCMR § 3104.1, for a special exception to allow a community service center under section 334, in the R-5-A District at premises 700 block (cul-de-sac) of 8th Street, S.E. (Square 6209, Lots 28-31).

17480 - Application of MissionFirst Development, pursuant to 11 DCMR § 3103.2, for a variance from the minimum lot width and area requirements under section 401, to allow the construction of eight (8) semi-detached dwellings in the R-5-A District at premises 4675 H Street, S.E., 5001 and 5007 Benning Road, S.E. (Square 5362, Lots 193, 194 and 195).

17482 - Appeal of Advisory Neighborhood Commission 6A, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator, Department of Consumer and Regulatory Affairs (DCRA) to issue Certificate of Occupancy Permit No. 106898, dated November 1, 2005, allowing the operation of a restaurant (Adams Family Restaurant, Inc. trading as Birdland 4Sisters Cuisine). Appellant alleges that the subject business operation falls within the definition of a fast food restaurant under section 199 (Definitions) and should have received special exception approval under section 733 (Fast Food Restaurants). The subject property is located in the HS/C-2-A District at premises 1118 H Street, N.E. (Square 981, Lot 80.)

17483 - Application of RLA Redevelopment Corporation, pursuant 11 DCMR § 3103.2, for variances from the residential recreation space requirements under section 773, and a variance from the loading berth requirements under subsection 2201.1, to allow the construction of a new mixed-use (residential/retail) building in the C-2-B District at premises 1414 Belmont Street, N.W. (Square 2660, Lot 235).

17429 - Application of Friends of St. Patrick’s Episcopal Day School LLC, pursuant to 11 DCMR § 3104.1, for a special exception to allow the development of 19 single-family detached dwellings as a theoretical lot subdivision under section 2516, and a special exception to construct a private middle and high school (440 students and 100 faculty and staff) under section 206, in the R-1-B District at premises 1801 Foxhall Road, N.W. (Square 1346, Lots 825, 826 and 827) The school is proposed to be located on Lot 827.

17488 - Application of Mr. & Mrs. Lester Allen, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy provisions under section 403, a variance from the nonconforming structure provisions under subsection 2001.3, and a variance from the rear yard area requirements under subsection 2500.3, to allow an addition to an existing single-family dwelling and stair addition to an existing accessory garage in the R-4 District at premises 633 E Street, N.E. (Square 862, Lot 173).

17484 - Application of SharCon Hospitality of D.C., Inc. on behalf of Suton LLC, pursuant to 11 DCMR § 3103.2, for a variance from the maximum height of buildings provisions under section 840, and a variance from the minimum number and size of loading berths and platforms under section 2201, to construct a five (5) story Holiday Inn Express on Parcel A and a Five (5) story Fairfield Inn & Suites on Parcel B, in the C-M-1 District at premises 1917 Bladensburg Road, N.E. (Square 4393, Lots 815 and 821).

17485 - Application of RSP Naylor LLC, pursuant to 11 DCMR § 3103.2, for a variance from the buildings on alley lot height requirement under subsection 2507.4, and a variance from the nonconforming structure provisions subsection 2001.3, to construct two row dwellings in the R-4 District at premises 1321-1325 Naylor Court, N.W. (Square 367, Lot 862).

17427 - Application of Frederick Davis, pursuant to 11 DCMR § 3103.2, for a variance from the minimum lot area requirements under subsection 401.3, to allow the conversion of three contiguous row dwellings into three separate apartment houses (having three (3) units each), in the R-4 District at premises 221, 223 and 225 11th Street, S.E. (Square 969, Lots 45, 46 and 47).

17487 - Application of Andy Cassell and Louis Persic, pursuant to 11 DCMR § 3103.2, for a variance from the alley width requirements under subsection 2507.3, to allow the conversion of an existing two story carriage house, on an alley lot, for use as a single-family dwelling in the R-4 District at premises Rear 2024 1st Street, N.W. (Square 3116, Lot 806).

17486 - Application of Parkside Terrace Development LLC, pursuant to 11 DCMR § 3103.2, for a variance from the floor area ratio requirements under section 402, and pursuant to 11 DCMR § 3104.1, a special exception to allow more than one roof structure under subsection 411.11, and a special exception to allow convenience services as an adjunct to an existing twelve story apartment building under section 354, in the R-5-A District at premises 3700 9th Street, S.E. (Square 5926, Lot 3).

17463 - Application of ARCH Training Center, pursuant to 11 DCMR § 3103.2, for a variance from the off-street parking requirements under subsection 2101.1, to convert a vacant community residence facility and re-occupy it as an apartment house (29 units) in the R-5-A District at premises 2025 Fendall Street, S.E. (Square 5777, Lot 952).

17491 - Application of David Getson and Craig Collins, pursuant to 11 DCMR § 3104.1, for a special exception to construct a two story rear addition to an existing single-family row dwelling under section 223, not meeting the lot occupancy (section 403) requirements, and open court (section 406) requirements in the R-4 District at premises 1303 T Street, N.W.
