17309 - Application of Dorchester Associates LLC, pursuant to 11 DCMR § 3104.1, for a special exception under section 2516, to allow thirteen detached single-family dwellings on a single subdivided lot, including approval of two sixteen foot wide roadways rather than twenty-five foot wide roadways under subsection 2516 (d), in the CBUT/R-1-A District in the 2800 block of Chain Bridge Road, N.W. (Square 1425, Lot 827, Parcels 12/63, 12/293 and 12/294). 17532 - Appeal of AppleTree Institute for Education Innovation, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator (ZA), Department of Consumer and Regulatory Affairs (DCRA) to require BZA special exception approval for a proposed addition to an existing public charter school. Appellant also alleges that the ZA erroneously relied upon the Zoning Commission’s 2/13/06 emergency rulemaking to require additional on-site parking spaces. (Square 2072, Lot 30). 17550 - Application of Frost-Labule LLC, pursuant to 11 DCMR § 3103.2, for a variance from the floor area ratio requirements under section 402, a variance from the off-street parking requirements under subsection 2101.1, and pursuant to 11 DCMR § 3104.1, a special exception to allow the construction of a 37-unit apartment house for low-income senior citizens under section 353, in the R-5-A District at premises 2620 Bowen Road, S.E. (Square 5869, Lot 962). 17555 - Application of Karthik Ramanathan and Innessa Manning, pursuant to 11 DCMR § 3104.1, for a special exception to allow a rear addition to an existing single-family row dwelling under section 223, not meeting the lot occupancy (section 403) and open court (section 406) requirements in the DC/R-5-B District at premises 2128 O Street, N.W. (Square 69, Lot 226). 17556 - Application of Murillo/Malnati Group, pursuant to 11 DCMR § 3103.2, for a variance from the rear yard requirements under section 404, to allow the renovation of four existing row dwellings and the construction of a new addition at the rear of the property, having a total of 33 residential units in the R-5-D District at premises 2816-2822 Connecticut Avenue, N.W. (Square 2107, Lots 56, 57, 75, and 76). 17549 - Application of Georgetown Visitation Preparatory School, pursuant to 11 DCMR § 3104.1, for a special exception to increase a private school student enrollment cap from 435 to 490, and to increase the cap on faculty and staff from 110 to 120, under section 206, in the R-3 District at premises 1524 35th Street, N.W. (Square 1292, Lot 202). 17540 - Application of Capitol Hill Day School, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 404, a variance from the rear yard requirements under section 403, and a variance from the parking requirements under subsection 2117.2, and pursuant to 11 DCMR §§ 1202.1 and 3104.1, a special exception to allow the construction of an addition to a private school under section 206, in the CAP/R-4 District at premises 210 South Carolina Avenue, S.E. (Square 765, Lot 803). 17541 - Application of Capitol Hill Day School, pursuant to 11 DCMR §§ 1202.1 and 3104.1, a special exception to allow the continued operation of a private school for thirty (30) students in pre-kindergarten through eighth grade and five (5) faculty and staff members in the basement through the second floor under section 206, in the CAP/R-4 District at premises 214 South Carolina Avenue, S.E. (Square 765, Lot 802). 17537 - Application of Victor Tabbs, pursuant to 11 DCMR § 3103.2, for a variance from the limitation on the number of stories under subsection 400.1, to construct a four (4) story rear addition to a flat (two-family dwelling) at premises 714 13th Street, S.E. (Square 1045, Lot 97). 17553 - Application of Naun Segovia, pursuant to 11 DCMR § 3103.2, for variances from the building height and story limitations under section 400, a variance from the rear yard requirements under section 404, a variance from the open court requirements under section 406, and a variance from the prohibition on enlarging a structure devoted to a nonconforming use under subsection 2002.5, to allow the expansion of an existing apartment house from 20 units to 34 units in the R-4 District at premises 1327 Euclid Street, N.W. (Square 2861, Lot 4). 17558 - Application of Principality LLC, pursuant to 11 DCMR § 3103.2, for a variance from the lot width requirements under section 401, and a variance from the side yard requirements under section 405, to allow the construction of a new single-family detached dwelling in the R-2 District at premises 3357 Martin Luther King, Jr. Avenue, S.E. (Square 6004, Lot 12). 17557 - Application of Erie Homes Inc., pursuant to 11 DCMR § 3103.2, for a variance from the floor area ratio requirements under section 402, and pursuant to 11 DCMR § 3104.1, a special exception to allow the construction of five (5) flats (two-family row dwellings) under section 353, in the R-5-A District at premises 122-130 50th Street, S.E. (Square 5327, Lot 800). 17552 - Application of Benedictine Foundation, on behalf of St. Anselm’s Abbey School, for a special exception pursuant to 11 DCMR § 3104.1, to allow the construction of an addition to a private school building, and to increase the number of students from 260 to 280, and the number of employees from 50 to 70, under section 206, in the R-1-B District at premises 4501 South Dakota Avenue, N.E. (Square 3977, Lot 133). 17551 - Application of Mustafa Guldu, pursuant to 11 DCMR § 3103.2, for a variance from the lot occupancy requirements under section 403, a variance from the side yard requirements under section 405, and a variance from the prohibition on enlarging a structure devoted to a nonconforming use under subsection 2002.5, to allow a two story addition to an existing flat (two-family dwelling) in the R-2 District at premises 4323 River Road, N.W. (Square 1653, Lot 16). 17509 - Application of Bernard L. Renard, pursuant to 11 DCMR § 3103.2, for a variance from the lot area and lot width requirements under section 401, a variance from the lot occupancy requirements under section 403, a variance from the court area and width requirements under section 406, a variance from the nonconforming structure provisions under subsection 2001.3, and a variance from the accessory structure alley setback requirements under subsection 2300.2(b), to allow additions to two row dwellings sharing the same lot in the R-4 District at premises 521-523 11th Street, S.E. (Square 973, Lot 67). 17561 - Application of Ari Karen, pursuant to 11 DCMR § 3104.1, for a special exception to allow a rear addition to a flat (two-family dwelling) under section 223, not meeting the lot occupancy (section 403), and open court (section 406), requirements in the R-4 District at premises 1641 13th Street, N.W. (Square 277, Lot 41). 17562 - Application of W Street, SE 38-42-43 LLC, pursuant to 11 DCMR § 3103.2, for a variance from the off-street parking requirements under section 2116, and pursuant to 11 DCMR § 3104.1, a special exception to construct six (6) three-unit row dwellings under section 353, in the R-5-A District at premises 1749-1759 W Street, S.E. (Square 5755, Lots 38-43). 17533 - Appeal of Advisory Neighborhood Commission 6A, pursuant to 11 DCMR §§ 3100 and 3101, from the administrative decision of the Zoning Administrator (ZA), Department of Consumer and Regulatory Affairs (DCRA) to issue Building Permit No. B98956 approving the construction of a three (3) unit apartment house. Appellant alleges that the apartment use is in violation of several sections of 11 DCMR, including subsections 330.5, 401.3, and 2101.1. The subject property is located in the R-4 District at premises at 1405 North Carolina Avenue, N.E. (Square 1056, Lot 88). |
